Who we are and this agreement
Brey Archives is a video membership website operated by Brey Media LLC, a limited liability company registered in Wyoming, United States, at 30 N Gould St, Ste R, Sheridan, WY 82801, United States (“we”, “us”). These terms are the agreement between you and us when you use the website, create an account or buy a membership. Our privacy policy explains what we do with your personal information, and our refund and cancellation policy is part of these terms.
By creating an account or buying a membership you accept these terms. If you do not accept them, please do not use the website.
Who can join
You must be at least 18 years old, and old enough to enter a contract where you live, to create an account or buy a membership. The website is not intended for anyone younger.
Your account
- Give a correct e-mail address you can receive mail at, and keep it up to date.
- An account is for one person. Keep your password to yourself and do not share your account; you are responsible for what happens in it.
- Tell us straight away at support@breymedia.co if you think someone else has used your account.
- You can delete your account at any time from Account → Delete your account. Deleting it also cancels any Premium membership (no further payments are taken); it does not by itself refund what you have paid. The privacy policy explains what deleting removes and what is kept.
Free and Premium memberships
A free account costs nothing. It opens the videos we open to free members and the Community posts open to members; Premium videos and posts show with a blurred cover.
Premium is a paid membership. It opens every full video in the archive, new videos as they are added and the full Community, for as long as the membership lasts. The plans are monthly and for 3, 6 or 12 months; each plan gives the same access — a longer plan simply costs less per month.
The videos are streamed from the website to a web browser; they are not downloaded and there is nothing to install. The content is not explicit. The catalogue changes over time: we add videos, and we may edit or remove individual videos or posts.
Prices and payment
- The price of each plan is shown on the plans page and again at checkout before you pay. Prices are in US dollars and already include any sales tax or VAT we charge — the price you see is the price you pay.
- Payments are processed by Stripe on a secure payment page. We never see or store your full card number.
- If your card is in another currency, the checkout may show the price in your currency; any conversion is made by Stripe or your bank, at their rates.
- We may offer discount codes or promotions. Each applies only as described when it is offered.
- If we change the price of a plan, we will tell you by e-mail before the new price applies to your membership, and you can cancel before it does.
Automatic renewal and reminders
Every plan renews automatically at the end of each term — every month, or every 3, 6 or 12 months — and the same US-dollar price is charged to the same payment method, until you cancel. You agree to this when you tick the box at checkout, under the plan summary that states the amount and how often it is charged. If you pay in another currency, the amount in that currency can change with the exchange rate. A discount you accept applies as it was offered.
Before each renewal of a 3-, 6- or 12-month plan we e-mail you a reminder with the date and the amount. If a renewal payment fails, we and Stripe may try it again and let you know; if it cannot be collected, Premium ends.
Cancelling
You can cancel at any time, in a few taps, from Account → Membership. Cancelling stops the next charge; your Premium access continues until the end of the time you have already paid for, and then your account continues as a free account. When you cancel we may offer you a discount to stay; you are never obliged to take it.
Changing plan
A Premium member can move to another plan from the Membership page or the plans page. A longer plan starts straight away: you pay its price less the unused part of your current plan, and you see the exact amount before you confirm. A shorter plan starts when your current plan ends, and nothing is charged until then. A change cannot be made while a payment has failed, while your membership is set to end, while a discount you accepted is still to be used, or while another change is booked.
Refunds and your right to cancel
When you buy Premium, or move to a longer plan, you ask for access straight away. What that means for the 14-day right to cancel depends on where you live:
- Outside the EU and EEA — in the UK, for example — you accept that you lose the 14-day right to cancel and be refunded that consumers otherwise have for online purchases.
- In the EU and EEA you keep the right to withdraw within 14 days of paying for a new membership or a longer plan. If you withdraw, Premium ends and we refund what you paid less an amount for what you had until you withdrew: the larger of the price for the days you had Premium, in proportion to the plan’s length, and one month’s price multiplied by the share of the Premium videos you watched, each counted by how far you watched it — never more than you paid. We refund within 14 days of your request.
You confirm which applies in the box you tick, and we confirm it in the e-mail that follows. The words at checkout follow the country your connection comes from; the right follows where you live.
Apart from that right, once access has started the current term is not refunded as a rule — but a person reads every refund request and decides it on its facts, and a refund, when we give one on a request, is of the whole payment and ends Premium at once. The refund and cancellation policy sets out how to ask and what happens. Nothing in these terms takes away rights you have by law.
Charges you don’t recognise
If you do not recognise a charge from BREYARCHIVES or think you were charged by mistake, please contact us promptly at support@breymedia.co, with the date and the amount. You can also contact your bank or card provider. A payment disputed with your bank ends the membership at once: Premium stops and no further payments are taken. If your bank warns us that a payment may be fraudulent, we refund it at once and end the membership, and the card may be blocked from paying us again. In a dispute we may share with the bank the records of your purchase and of your use of the membership.
Using the videos and posts
All videos, photos, text and other material on the website belong to Brey Media LLC or are used with permission. Your membership gives you a personal, non-transferable permission to watch and read them on the website, for your own private, non-commercial use, while your membership lasts.
You may not download, record, copy, re-upload, share, sell, broadcast or publish any of it, in whole or in part — including screen recordings and screenshots of the videos — or use it to train or feed any software.
What you may not do
- Share your account or your access, or buy memberships to resell them.
- Get around the membership levels, the video protection or any other security measure, or access parts of the website you are not meant to.
- Use bots, scrapers or any automated means to access the website, or put an unreasonable load on it.
- Use a payment method you are not entitled to use.
- Use the website in a way that breaks the law or harms the website, us or anyone else.
Changes to the service
We work to keep the website available and running well, but we cannot promise it will never be interrupted — for example for maintenance or because of a problem with a provider we rely on. We may change, add or remove features. If a change takes away something important you paid for, you can cancel, and you can ask us for a refund under the refund policy.
Suspending or closing an account
We may suspend or close an account that breaks these terms — for example by sharing access, copying the videos or making fraudulent payments — and we may cancel its membership. Where the breach is serious we do not have to refund the rest of the term. Where we close an account without any fault of yours, we refund the part of your current term you can no longer use.
Our responsibility to you
We provide the website with reasonable care and skill. Beyond that, and to the extent the law allows, it is provided “as is”, and we are not responsible for losses that were not foreseeable, for business losses, or for problems caused by your device, your internet connection or events outside our reasonable control. To the extent the law allows, our total responsibility to you is limited to the amount you paid us in the 12 months before the problem arose.
Nothing in these terms limits responsibility that the law does not allow to be limited — including for death or personal injury caused by negligence, for fraud, or your rights as a consumer.
Law and disputes
These terms are governed by the laws of the State of Wyoming, United States. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts. If something goes wrong, please write to us first — most problems are solved quickly that way.
Changes to these terms
We may update these terms, for example when the website or the law changes. We will show the date of the latest version at the top of this page, and tell members by e-mail about important changes before they take effect. If you do not agree to a change, you can cancel your membership or delete your account.
